PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING

Effective Date: April 16, 2024

The following terms and conditions govern all engagements and purchase agreements between Annie Mackenzie Consulting LLC, DBA Money Essentials for Women, www.money-essentials.com (“AMC”; including website and blog content, social media content, online products and programs, or 1:1 or group coaching or consulting services), and any individual or organization wishing to engage with its products and services (“Sponsor”). By engaging with or purchasing items from AMC, Sponsor is agreeing to the terms and conditions outlined in this document, which may change at any time without notice. If Sponsor does not agree with these terms and conditions, they should not engage with AMC. The parties agree to the following:

General Disclaimer

All information put forth by AMC, including website, blog, social media, online courses and programs, and 1:1 and group coaching and consulting content, is meant to be educational information, not financial or investment advice. AMC does not represent a certified tax or investment professional organization; Sponsor should consult their certified financial advisor, retirement representative, certified professional accountant, or other professional advisor before making changes to their financial accounts. The mission of AMC is to share personal experiences and general educational content to spread awareness and empower women with financial information. Please note that there is an inherent risk involved in investing in the stock market, and AMC does not guarantee earnings or investment results.

Intellectual Property

Sponsor understands and acknowledges that all content, materials, and services provided by AMC are available for personal use and engagement by the Sponsor only, and cannot be reproduced or shared for commercial purposes without permission from AMC. AMC shall retain all rights to AMC intellectual property.

Purchase, Fulfillment, and Refund Policy

Sponsor can purchase products, programs, and services through AMC website and online storefront. All products, programs, and services are described in detail on the storefront, including purchase price at time of purchase. AMC is as accurate as possible with all information describing goods and services, including product and service descriptions and images. By engaging with or purchasing goods with AMC, you hereby agree that you are purchasing these products or services at your own risk.

All online purchases of digital products or coursework will be delivered to the Sponsor’s email provided upon purchase. All 1:1 or group coaching will be delivered according to the schedule agreed upon by the Sponsor and AMC at time of purchase.

All products, programs, and services purchased through AMC are final sales. No refunds are available for any purchases through AMC.

Neither party will be responsible for or liable to the other party for non-performance or delay in performance of any terms or conditions of this agreement due to acts or occurrences beyond the reasonable control of the nonperforming or delayed party. Such causes include, but are not limited to, acts of God, acts of government, embargoes, terrorism, wars, riots, strikes or other labor disputes, shortages of labor or materials, hurricanes, fires, floods, or any other circumstances of like character. The party whose performance is delayed or prevented shall promptly provide to the other party written notice of the existence of and the reason for such non-performance or delay, and shall work diligently to mitigate its effects and make best efforts to resume performance as soon as practicable.

Collection of Identifying and Payment Information

Sponsor may be asked to register with AMC to engage with or purchase products, programs, or services. Sponsor may be asked to provide personal information including but not limited to name and email; Sponsor is responsible for ensuring the accuracy of this information. The billing information provided by Sponsor is subject to the same confidentiality and accuracy requirements as the rest of Sponsor’s identifying information; providing false information is grounds for immediate termination of all agreement(s) between Sponsor and AMC.

Expectations of Sponsor

All products, programs, services, and content developed by AMC are meant to be educational, not financial advice. Sponsor is fully responsible for their use of any educational content and for seeking certified financial advice before making financial decisions. AMC does not assume liability for any errors in educational content. AMC does not guarantee specific results for any individual or organization.

Age Restriction

Sponsor must be at least 18 years old to engage with or purchase products, programs, or services through AMC. By engaging with AMC, Sponsor warrants that they meet the minimum age of 18. AMC assumes no liability for misrepresentation of Sponsor age.

Termination

Sponsor agrees that AMC may terminate any agreement(s) between Sponsor and AMC at any time with or without cause, and AMC reserves the right to terminate agreement(s) if Sponsor does any of the following, but not limited to: violates intellectual property rights; failure to comply with laws; publishing illegal materials.

Affiliate Marketing and Advertising

AMC may engage in affiliate marketing whereby AMC receives a commission or percentage of sales for referral purchases made by the Sponsor; affiliate purchases incur no additional cost to the Sponsor. AMC may share advertisements through website or other content and receive compensation for referral purchases made by Sponsor. This disclosure is intended to comply with the US Federal Trade Commission Rules on marketing and advertising, as well as any other legal requirements which apply.

Limitation of Liability

AMC is not liable for any damages that may occur to Sponsor as a result of Sponsor’s use of AMC content, materials, programs, or services, to the fullest extent permitted by law.

Indemnity

Sponsor shall indemnify, defend, and hold harmless all AMC members, representative, and affiliates against any claims, losses, damages, and expenses (including attorney fees) that arise out of AMC member, representative, or affiliate actions taken on behalf of AMC, provided such actions are taken in good faith and within the scope of their authority.
